User Agreement

For Hallucination Inc. Last updated: 2026-10-21 Wersja polska

Effective date: October 21, 2026

1. About these terms

  1. These terms govern your use of the game Hallucination Inc. on iOS (“the Game”).
  2. The Game is published by Damian Wiśniewski, a sole trader operating as Uniso Damian Wiśniewski (brand: TheHardWay Studio), Polish tax ID (NIP) 7772903993, registered in the Polish Central Register and Information on Economic Activity (CEIDG), thehardway.pl, e-mail: contact@thehardway.pl (“the Developer”, “we”). The Developer’s address and other registration details are available in the CEIDG business search (search by NIP).
  3. The Game is distributed through the App Store. Your use of it is also governed by the Apple Standard End User License Agreement (EULA) and the Apple Media Services Terms and Conditions. If they conflict, Apple’s license agreement prevails, and mandatory consumer protection law prevails over both.
  4. By downloading or playing the Game, you accept these terms. If you don’t agree, please don’t use the Game.

2. What the Game is

Hallucination Inc. is an idle game about running an AI startup: from a laptop and a single prompt, through machines and agents, to selling the company and founding the next one.

The Game is satire. Companies, AI models, investors, news headlines, quotes and characters in the Game are fictional. Any resemblance to real companies, products or people is coincidental or intended as parody and does not imply any affiliation or endorsement. Nothing in the Game is business, investment, legal or technology advice, and the Game’s currency, valuations and funding rounds have nothing to do with real money.

3. Requirements

  • iPhone with iOS 17.6 or later.
  • An Apple Account (Apple ID) to download the Game and make in-game purchases.
  • The Game works offline. An internet connection is needed for ads, purchases, restoring purchases and Game Center.

4. License

  1. We grant you a non-exclusive, non-transferable, revocable license to use the Game for personal purposes on Apple devices you own or control, under Apple’s license agreement and these terms.
  2. You may not: decompile or modify the Game (except where the law allows it), bypass the purchase or ad reward mechanisms, tamper with scores sent to Game Center, resell or share the Game for a fee, or remove copyright notices.
  3. The Game’s name, logo, icon, artwork, texts, music and code are protected by copyright and belong to the Developer. Apple, iPhone, iOS, Game Center and App Store are trademarks of Apple Inc.; Google and AdMob are trademarks of Google LLC. The Game is not affiliated with these companies beyond using their services.
  4. You may record and publish gameplay footage (videos, streams, screenshots), including monetized content, as long as you don’t present it as official Developer material.

5. In-game purchases

  1. The Game is free. You can buy one-time upgrades (non-consumable purchases, no subscriptions) that permanently change gameplay, for example letting you collect rewards without watching ads or increasing production. The Game describes what each upgrade does before you buy it.
  2. Prices are shown in the Game and on the App Store before purchase, in your store’s currency, and include any taxes required in your country.
  3. Purchases are tied to your Apple ID. After reinstalling the Game or on another iPhone, use “Restore purchases” in the Game’s settings. Purchases don’t carry over to other platforms (such as a future Android version).
  4. Currency, Reputation, valuations and other in-game resources have no monetary value and cannot be exchanged for money or transferred outside the Game.
  5. Payments are handled solely by Apple. We have no access to your payment details and cannot technically refund a charge. You can request a refund from Apple at reportaproblem.apple.com.
  6. We may change the Game’s balance (for example upgrade prices in the in-game currency or production speed), but we won’t take away a purchased upgrade or change its core benefit as described at purchase.

6. Rewarded ads

  1. Ads in the Game are optional only: you watch one only when you choose an ad reward. The Game never shows forced ads.
  2. You get the reward after watching the ad to the end. If you close the ad early or no ad is available (no internet, no ads in your region, consent declined), no reward is given and the Game shows that the campaign is unavailable.
  3. We don’t guarantee that ads are always available, and we may change ad rewards and limits.
  4. Ads are served by Google AdMob, and we don’t choose individual ads. If an ad seems inappropriate, you can report it to contact@thehardway.pl. How data is processed for ads is described in the Privacy Policy.

7. Game progress and Game Center

  1. Your progress is stored only on your iPhone. The Game has no account and no cloud backup, so deleting the Game or losing the device deletes your progress, and we can’t recover it. You can restore purchased upgrades with your Apple ID (Section 5.3).
  2. Achievements and leaderboards run on Apple Game Center. Your Game Center nickname and profile belong to Apple and follow Apple’s rules.
  3. We may remove leaderboard scores that appear manipulated (for example achieved by modifying the Game or the device clock).

8. Liability

  1. We do our best to make the Game work properly, but we don’t guarantee that it will run without interruptions or bugs on every device and iOS version.
  2. To the extent permitted by law, we are not liable for indirect damages or lost profits. Our total liability is limited to the amount you paid for in-game purchases in the 12 months before the event.
  3. The limits in paragraph 2 don’t apply to intentional damage or where the law doesn’t allow liability to be limited, and they don’t limit consumer rights (Section 9).

9. Consumers

  1. If you are a consumer, you have the rights granted by consumer protection law, including rules on the conformity of digital content with the contract. For consumers in Poland this is the Consumer Rights Act of 30 May 2014.
  2. Right of withdrawal: as a rule, you may withdraw from a distance contract within 14 days. This right does not apply to digital content not supplied on a tangible medium if performance began with your express consent before the withdrawal period ended and after you were informed that you would lose this right. Purchases are handled by Apple, and refund requests go through reportaproblem.apple.com.
  3. If you are a consumer in another country, you keep the protection of the mandatory laws of your country of residence where they are more favorable to you.
  4. Consumers in Poland can use out-of-court dispute resolution, such as municipal or district consumer ombudsmen. More information: UOKiK.

10. Complaints

  1. Send complaints about how the Game works to contact@thehardway.pl. Describe the problem, include your Game and iOS versions and, if possible, a screenshot.
  2. We’ll reply within 14 days of receiving your complaint.
  3. Payments, charges and refunds are handled by Apple.

11. Ending use

You can stop playing and delete the Game at any time. We may end your license if you seriously breach these terms, in particular by bypassing the purchase or ad reward mechanisms. We may also stop developing or distributing the Game; an installed Game with purchased upgrades will then keep working offline, as far as the operating system allows.

12. Changes to these terms

We may change these terms for valid reasons, such as changes in the law or in the Game’s features, purchases or ads. Changes don’t affect rights acquired before they take effect, including purchased upgrades. The current version is always available at this address, with the date of the last update at the top of the page.

13. Governing law

These terms are governed by Polish law. Disputes are resolved by the competent Polish courts under general rules, subject to mandatory consumer protection laws. If any provision is found invalid, the rest remains in force. These terms are also available in Polish; if the versions differ, the Polish version prevails.
