Terms of Use

For Czas Pracy Last updated: 2026-09-27 Wersja polska

Effective date: September 27, 2026

1. About these terms

  1. These Terms of Use govern your use of the macOS app Freelance Hours, sold in Poland as Czas Pracy (“the App”).
  2. The App is published by Damian Wiśniewski, TheHardWay Studio, thehardway.pl, e-mail: contact@thehardway.pl (“we”, “us”, “the Developer”).
  3. The App is distributed through the Mac App Store. Apple’s Licensed Application End User License Agreement (EULA) and the Apple Media Services Terms and Conditions also apply. If they conflict with these terms, Apple’s EULA prevails; mandatory consumer protection law prevails over both.
  4. By downloading or using the App you accept these terms. If you don’t, please don’t use the App.

2. What the App is

The App helps you track your own working time on projects: start a timer from the menu bar, add and edit time entries, keep clients and projects with hourly rates, review summaries and export reports.

The App is not:

  • an employee time-recording system under labor law and is not meant to fulfil an employer’s record-keeping duties,
  • accounting or invoicing software; the PDF report is a timesheet you can attach to an invoice, not an invoice or an accounting document,
  • tax, legal or financial advice; amounts calculated from your rates are an estimate of the value of your work.

You are responsible for the accuracy of the data you enter and for how you use the reports (for example when billing a client).

3. Requirements

  • A Mac running macOS 26 or later.
  • An Apple Account to download the App and make in-app purchases.
  • An internet connection is needed only to buy, restore or verify PRO.

4. License

  1. We grant you a non-exclusive, non-transferable, revocable license to use the App on Apple devices you own or control, subject to Apple’s EULA and these terms.
  2. You may not: decompile or modify the App (except where the law allows it), bypass the purchase or PRO entitlement system, resell or commercially provide the App to third parties, or remove copyright notices.
  3. The App’s name, logo, icon, interface and code are protected by copyright and belong to the Developer. Apple, Mac, macOS, iCloud, Siri and App Store are trademarks of Apple Inc.; the App is not affiliated with Apple beyond App Store distribution.

5. Free version and PRO

5.1 Free version

The free version lets you keep one active project, with unlimited time entries, and export CSV. Entries you’ve already saved stay available even after PRO ends.

5.2 PRO

PRO unlocks unlimited projects, PDF report export, and backing up and restoring your data to and from a file. The “Plan PRO” screen in the App describes what PRO includes.

PRO comes in two forms:

OptionTypeAccess
Lifetime accessone-time in-app purchasepermanent, no further payments
Monthlyauto-renewable monthly subscriptionwhile the subscription is paid

Prices are shown in the App and on the App Store before you buy, in your storefront’s currency, and include any taxes required in your country.

5.3 Free trial

The monthly subscription may include a 7-day free trial for new subscribers, if it’s offered on the App Store at that time. The trial is available once per Apple Account. Unless you cancel at least 24 hours before the trial ends, you’ll be charged for the first month when it ends.

5.4 Auto-renewal

  • Payment is charged to your Apple Account at confirmation of purchase (or when the free trial ends).
  • The subscription renews automatically unless it’s canceled at least 24 hours before the end of the current period.
  • Your account is charged for renewal within 24 hours before the end of the current period.
  • You manage and cancel your subscription in your Apple Account settings: in the App Store on your Mac (click your name → Account Settings → Subscriptions), at apps.apple.com/account/subscriptions, or with the “Manage subscription” button in the App.
  • After you cancel, PRO stays active until the end of the paid period. Any unused portion of a free trial is forfeited when you purchase a subscription, where Apple’s rules provide so.

5.5 Restoring purchases

Purchases are tied to your Apple Account. After reinstalling the App or on another Mac, use the “Restore purchase” button in the App.

If you have both an active subscription and lifetime access, cancel the subscription in your Apple Account settings to avoid further charges. We can’t do this for you.

5.6 Payments and refunds

Apple processes all payments. We have no access to your payment details and can’t technically issue refunds. You can request a refund from Apple at reportaproblem.apple.com.

5.7 Price and feature changes

We may change prices and the App’s features. Apple notifies subscribers of subscription price changes under its own rules; if you don’t agree, you can cancel. We’ll make reasonable efforts not to remove key PRO features from people with an active PRO plan.

6. Your data

  1. The data you enter belongs to you and is stored only on your Mac. See the Privacy Policy for details.
  2. We don’t keep a copy of your data and can’t recover it. Export or back up regularly, especially before switching Macs or reinstalling macOS.
  3. Restoring from a backup replaces all data currently stored in the App. The App asks you to confirm; once confirmed, it can only be undone by restoring another backup.
  4. You are responsible for keeping exported files and backups safe.

7. Liability

  1. We do our best to make the App work well, but we don’t guarantee it will run without interruptions or errors on every hardware and software configuration.
  2. To the extent permitted by law, we are not liable for indirect damages, lost profits, or decisions made based on the App’s reports and calculations. Our total liability is limited to the amount you paid for the App in the 12 months before the event.
  3. The limits in paragraph 2 don’t apply to intentional damage or where the law doesn’t allow liability to be limited. They don’t limit the rights of consumers or of sole traders who enjoy consumer rights (Section 8).

8. Consumers and sole traders

  1. If you are a consumer, you have the rights granted by applicable consumer protection law, including those concerning the conformity of digital content and services with the contract.
  2. Under Polish law (Art. 38a of the Consumer Rights Act of 30 May 2014), the same rights regarding withdrawal and conformity of digital content also apply to a natural person running a sole proprietorship, if the contract is directly related to their business but is not of a professional nature for them.
  3. Right of withdrawal: as a rule, you may withdraw from a distance contract within 14 days. This right doesn’t apply to digital content not supplied on a tangible medium if performance has begun with your express prior consent and your acknowledgment that you thereby lose the right of withdrawal (Art. 16(m) of Directive 2011/83/EU; in Poland Art. 38(1)(13) of the Consumer Rights Act). Apple handles purchases, and refund requests go through reportaproblem.apple.com.
  4. If you are a consumer outside Poland, you keep the protection of the mandatory laws of your country of habitual residence where they are more favorable to you.

9. Complaints

  1. Send complaints about how the App works to contact@thehardway.pl. Describe the problem, include the App and macOS versions and, if possible, a screenshot.
  2. We’ll reply within 14 days of receiving your complaint.
  3. Apple handles matters related to payments, charges and refunds.

10. Ending use

You can stop using and delete the App at any time. Deleting the App does not cancel a subscription; do that in your Apple Account settings (Section 5.4). We may terminate your license if you seriously breach these terms, in particular by bypassing the purchase system. Data stored on your Mac remains yours.

11. Changes to these terms

We may change these terms for valid reasons, such as changes in the law, in the App’s features or in its purchase model. Changes don’t affect rights acquired before they take effect, including access to a PRO plan you’ve already paid for. The current version is always available at this address, with the update date at the top.

12. Governing law

These terms are governed by Polish law. Disputes are resolved by the competent Polish courts, subject to the mandatory consumer protection rules of your country of residence. If any provision is found invalid, the rest remain in force. If the Polish and English versions differ, the Polish version prevails, without prejudice to your mandatory consumer rights.
